Terms of Service
1. Acceptance of Terms
By accessing or using Kotha ("Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Who can use Kotha
- You must be at least 13 years old.
- You must provide accurate account information.
- One account per person — creating duplicate accounts is not permitted.
3. Your content
You retain ownership of all chat data you upload to Kotha. By uploading, you grant us a limited license to process and display that data solely to provide the Service to you.
You are solely responsible for ensuring you have the right to upload the chat data (e.g., chats involving other people). Do not upload chats without consent of the other participants where required by applicable law.
4. Acceptable use
⚠️ Violations may result in immediate account termination.
You agree not to:
- Use the Service for any illegal purpose.
- Upload content you do not own or have rights to.
- Attempt to access other users' data.
- Reverse-engineer, scrape, or abuse the AI or API.
- Use Kotha to harass, defame, or harm others.
- Create fake accounts or bypass plan limits.
- Upload CSAM or any content involving minors in a sexual context — this will be reported to authorities.
5. Plans and payments
Kotha offers a free plan and a paid Pro plan (₹99/month). Payments are processed by Razorpay. Subscriptions auto-renew unless cancelled. See our Refund Policy for cancellation terms.
We reserve the right to change pricing with 30 days' notice to existing subscribers.
6. Direct messaging (DM)
The DM feature allows registered users to message each other. By using DMs, you agree that:
- All messages are stored on our servers.
- Conversation logs may be reviewed by administrators in response to legal requests or abuse reports.
- You will not use DMs to spam, harass, or solicit other users.
7. Intellectual property
The Kotha name, logo, and all platform code are owned by Kotha. You may not use our branding without written permission.
8. Disclaimers
The Service is provided "as is" without warranty. The AI responses are generated by a language model and may not accurately reflect the real person. Do not rely on AI responses for medical, legal, financial, or emergency decisions.
9. Limitation of liability
To the maximum extent permitted by law, Kotha is not liable for any indirect, incidental, or consequential damages arising from your use of the Service.
10. Governing law
These Terms are governed by the laws of India. Disputes shall be subject to the jurisdiction of courts in Rajasthan, India.
